§ 191-4. Powers of Director.

  • The Director shall issue and renew operation and maintenance permits under this chapter in accordance with the Utility Service Procurement Policy in Section 191-3. B, above, provided that no permit shall be issued or renewed for the installation, operation or maintenance of a public pay telephone at any location where it will unreasonably interfere with the use of a Street by the public, or where it is a Public Nuisance as determined by the Chief in accordance with the applicable subsections of this Ordinance. Proposed locations for the installation of public pay telephones in accordance with the Utility Service Procurement Policy shall be based on the following requirements as set forth below:

    A.

    Prior to the issuance of a Request for Qualified Proposals, the Director must first give notice of the intention of the city to permit the location of a public pay telephone at a new location, by posting a public notice of the proposed public pay telephone location, 30 days in advance of any issuance of such permit, as pre-inspected by the Director or his designee and approved for compliance with the siting requirements set forth in this Ordinance.

    B.

    No permit shall be issued until the Owner submits a final specific site plan to the Director for his review and approval.

    C.

    The location of the public pay telephone must be approved by the Chief as to whether the proposed location is a Public Nuisance.

    D.

    A permit may be conditioned upon the limitation of the type of public pay telephone service.
